Atos: new trial in dispute with TriZetto

S. District Court for the Southern District of New York has ordered a new trial on compensatory damages allegedly owed by Syntel, now part of Atos, for alleged misappropriation of trade secrets and copyright infringement by Syntel.

This new trial is related to ongoing litigation between Syntel and Cognizant and its subsidiary TriZetto.

The case began in 2015, before Syntel was acquired by Atos in 2018.

'On May 25, 2023, the U.S. Court of Appeals for the Second Circuit reversed a decision issued by the U.S. District Court for the Southern District of New York in October 2020, ordering Syntel to pay damages for misappropriation of trade secrets and copyright infringement alleged by Syntel' says the group.

In its decision, the Second Circuit Court of Appeals found that the use of the avoided development cost methodology, which underlies the original damages award, was contrary to law. The Second Circuit Court of Appeals had remanded the case to the District Court to consider whether the damages amounts were still appropriate, which has now ordered a new trial' states the group.
